Terms of service

The agreement between you and GHBusinessDesk: what we do, what the authority and professional partners do, how fees work and what we guarantee.

1. About these terms

These terms are an agreement between you and GHBusinessDesk (“we”) for the use of our website, the MyBusiness customer portal and our services. By creating an account or placing an order, you agree to them. If you act for a business, you confirm you are authorised to agree on its behalf.

2. Who we are, and who we are not

GHBusinessDesk is a private company. We are not a government agency. Registration decisions are made by the relevant authority. Government fees are paid to the authority and shown separately. We are not a law firm, and we do not give legal or tax advice.

Three different parties may be involved in your application. Each has a different role:

3. Our services

Depending on what you order, we will:

  • ask guided questions and check your answers and documents for completeness and consistency
  • prepare forms from the information you give us, for your approval
  • submit applications and filings where the law allows us to, and track them
  • pass on and help you answer any query from the authority
  • deliver official documents to your secure vault
  • keep a compliance calendar and send reminders, and file on your behalf if your plan includes it

What each service includes is described on the service page and in your order before you pay.

4. No guarantee of approval or timing

Every registration and filing is decided by the relevant authority. We do not guarantee that an application will be approved, and we do not promise how long an authority will take. We guarantee our own service levels and the accuracy of our preparation, as set out below.

5. Fees

Every order shows up to three kinds of fee, each on its own line and naming who receives it:

  • Government fees are set by the authority and paid to it at cost. We add nothing to them. Each quote names the fee schedule and its effective date; government fees are verified again at checkout, and an order keeps the schedule in force when it was quoted.
  • The GHBusinessDesk service fee is our charge for the work. It is fixed for your selection and shown before you enter your details.
  • Professional fees are charged by a licensed partner for work only they may do. They are held and paid to the partner after the work is signed off as complete.

Service fees for customers abroad may be priced in US dollars. Paystack payments are charged in Ghana cedis. Where amounts are converted, we use the published exchange rate, shown with its source at checkout and fixed on your receipt. Figures on our website are approximate (about GHS 11.00 = US$1).

Priority handling adds 40% to our service fee and speeds up our own steps only. If you choose an authority’s own expedited service, its charge is passed through and shown as a government fee.

6. Our service levels

  • First review within 1 working day of payment
  • Submission within 1 working day of a complete, clean file
  • Replies within 4 working hours, 08:00–21:00 GMT
  • Documents in your vault within 1 working day of approval

Authority processing time is outside our control and is not covered by these service levels.

7. Professional services

Where the law requires a licensed professional, such as a lawyer, chartered accountant, qualified company secretary or commissioner for oaths, a vetted partner does that work under their own licence and professional responsibility. We coordinate and track it, and their fee is shown separately.

8. Your part

  • Give us information that is true, complete and up to date, and tell us promptly if it changes.
  • Make sure anyone whose details you give us, such as co-directors or shareholders, knows and agrees.
  • Respond to requests for information or approval within the time we give you.
  • Keep your sign-in details secure, and tell us at once if you think your account has been misused.
  • Use the service only for lawful purposes.

9. Documents

Official documents issued by an authority are delivered to your vault unaltered. Documents we produce, such as checklists, receipts and compliance summaries, carry our branding and are not official documents. A compliance status or letter from us is our own assessment, not a certificate from any authority.

10. Guidance is not legal advice

Our guides, checklists and messages are general guidance. They are not legal or tax advice. If you need advice on your own situation, a licensed partner can provide it.

11. Electronic approvals

You may approve applications and sign documents electronically where the law accepts it, under the Electronic Transactions Act, 2008 (Act 772). Where a wet-ink signature or witnessing is required, we will arrange it with you.

12. Cancellations and refunds

You can cancel an order at any time. What is refunded depends on how far the work has gone, as set out in our refund policy.

13. Our responsibility

We are responsible for the accuracy of our own preparation, for meeting our service levels and for keeping your data secure. If an application is rejected because of our error, we will rework it free or refund our service fee in full, and cover any repeat government fee.

We are not responsible for an authority’s decisions or delays, or for problems caused by information you gave us that was wrong or incomplete. Any limit on our liability will be set out here once reviewed by counsel: to be confirmed.

14. Complaints

If you are unhappy, tell us through your application, or at [email protected]. Our operations lead takes ownership of each complaint. We aim to acknowledge it within 2 hours and resolve it within 3 working days.

15. Ending the service

You may close your account at any time. We may suspend or end the service if it is used unlawfully or fraudulently, or if these terms are seriously breached. We keep records afterwards only as our privacy notice describes.

16. Governing law

These terms are intended to be governed by the laws of Ghana. Jurisdiction and dispute resolution: to be confirmed by counsel.

17. Changes to these terms

We may update these terms. We will show the date of the latest version, and tell customers in advance of significant changes. An order already placed continues on the terms that applied when it was placed.
